Virginia's New Hiring Laws Are Here: Is Your Business Ready?

By Vantage HR Consulting LLC

Virginia's hiring landscape has changed. New employment laws that took effect on July 1 require employers to rethink how they advertise positions, interview candidates, and determine compensation. While the new requirements, enacted under Senate Bill 215 and House Bill 636, are intended to promote pay transparency and equitable hiring practices, they also create new compliance obligations for employers. Even well-intentioned hiring practices that were acceptable in the past may now need to be updated.

Three Steps Employers Should Take Now

  1. Review all current job postings to ensure they include a good-faith salary range.
  2. Remove salary history questions from employment applications, screening forms, and interview guides.
  3. Train hiring managers on legally appropriate interview questions and documentation practices.
These changes also provide an excellent opportunity to review your recruiting and hiring practices as a whole. A proactive HR compliance review can help identify gaps before they become costly issues.
